Mandatory Overtime
Â
Mandy works 12-hour night shifts in the trauma intensive care unit. The unit holds 20 patients and is filled to capacity. Three more traumas come through the emergency department and are presently in surgery. These patients will need to be admitted to the unit directly from surgery. Two nurses have called in for the day shift, bringing the registered nurse staff count to six. The nurse-to-patient ratio in this unit is 1:2. The charge nurse is evaluating which patients may be transferred to the surgical or neuroscience intensive care units to bring down the patient census. However, there will still be a staffing deficit. The manager comes to Mandy and tells her that she will need to remain and work the next shift because there is insufficient staffing. Mandy has already worked four consecutive 12-hour shifts.
Â
1. Â Â Can the manager “force” Mandy to work the mandatory overtime?
2. Â Â How should Mandy respond to the request?
3. Â Â What is the ANA’s stance on Mandatory Overtime?
4. Â Â What are the legal ramifications if Mandy refuses to accept the assignment?
5. Â Â What recourse might Mandy have in this situation?
